A statement of claim filed with the Federal Circuit Court alleges Mr Myles, who is also principal of Winmalee Public School, underpaid 16 childcare workers almost $362,000. One employee was allegedly underpaid $49,533 over four years.

Seven of the former staff were under the age of 21 and some were trainees.

The Fair Work Ombudsman alleges the childcare workers were paid a flat hourly rate that did not cover minimum hourly rates, casual loadings, overtime rates, annual leave entitlements or a laundry allowance.

But some workers were paid well above their legal entitlements.

Mr Myles allegedly cut one employee’s hours after she made a complaint about her pay to the Fair Work Ombudsman.

Fair Work Ombudsman Natalie James said Mr Myles was allegedly well informed of his obligations as an employer, “but failed to ensure his business was compliant”.

He faces maximum penalties of between $3300 and $10,200 for each breach under the Fair Work Act. 

The Fair Work Ombudsman will seek a court order to be paid to the employees in lieu of reimbursements for the amount they were allegedly underpaid.

David McElrea, assistant secretary of United Voice NSW, the union for early childhood workers, said the starting wage for childcare workers was $18 an hour. He said payments of less than $4 an hour were “extraordinarily low”.

“These are not babysitters. These are professionals who should be paid as such,” Mr McElrea said.

“People struggle to get by on $18 an hour. It’s a poverty wage. So how any worker could survive off $3 or $4 an hour is beyond belief.”

Mr McElrea said many young women and new migrants worked in the childcare industry and were often exploited by unscrupulous employers.

“This industry needs proper regulation and an active role by government to ensure quality early education and care, including childcare workers being paid properly,” he said.

A spokesman for the NSW Department of Education said that as the regulator of childcare centres, it met with the provider on May 22 and issued a “show cause” notice that required it to demonstrate it had effective management and control of the service.

“The department was satisfied that the children were safe and sufficiently well cared for at this time and monitored the situation,” the spokesman said.

“During the period in which the ‘show cause’ notice was operative, the service went into voluntary administration.

“The administrator responded to the notice on the service’s behalf and the issues were subsequently deemed to have been satisfactorily resolved.”

The spokesman said the service has since been sold to another provider and is now operating as a long day care service under a different name. 

Fairfax Media attempted to contact Mr Myles for comment on Wednesday but the calls were not returned.
